Who this policy is for

Pragte hosts websites that people design themselves. Site owners are responsible for what they publish, as our Terms of Service explain, and they must own or have permission to use everything on their sites.

If you own the copyright in something and find it on a site made with Pragte without your permission, this policy explains how to ask us to take it down. If you own a site and something on it was taken down, it explains how to respond.

We respond to notices under the US Digital Millennium Copyright Act (“DMCA”, 17 U.S.C. § 512), and handle notices sent under similar laws elsewhere in the same way. Pragte is operated by Made4Uo LLC, whose designated agent for copyright notices is registered with the U.S. Copyright Office (see Our designated agent).

This policy covers every site published on a pragte.site address or on a domain connected to Pragte, draft preview links, template pages on pragte.net, pragte.com, and the Pragte app at pragte.app.

The quickest way is the notice form:

  • On the site itself. Add /report/copyright to the site’s address, for example name.pragte.site/report/copyright. On a site with the “Made with Pragte” badge, its menu has Report abuse, then Copyright or trademark issue.
  • For any address. Use pragte.site/report/copyright and type in the page’s address.

You can also send a notice by email or post to our designated agent.

A notice must include:

  1. Your physical or electronic signature. Typing your full name counts as an electronic signature.
  2. The copyrighted work you say is being infringed. If one notice covers several works on the same site, a representative list is enough.
  3. The material you say infringes, and enough information for us to find it: the address of each page, and what on that page uses your work.
  4. Your contact details: your name, postal address and email address, and a phone number if you have one.
  5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.

The form asks for each of these. If a notice is missing something, we may ask you for it, and we may not be able to act until we have it.

Before you send a notice, consider whether the use might be allowed without permission, for example as fair use. Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material infringes can be liable for damages. If you are not sure, you may want to speak to a lawyer.

What happens after a notice

  • We review every notice. When a notice is complete, we act promptly to remove or disable access to the material. This can mean taking the whole site offline until the material is removed.
  • We tell the site owner. We may send them a copy of the notice, including your name and email address, so they can respond.
  • We keep a record. Valid notices are recorded against the account that owns the site (see Repeat infringers).

A site owner who removes the material can ask us to put the rest of the site back online, and we will once the material is gone.

Counter notices

If something you published was removed or disabled and you believe that happened because of a mistake or misidentification, you can send a counter notice to our designated agent. It must include:

  1. Your physical or electronic signature.
  2. The material that was removed or disabled, and where it appeared before (the page’s address).
  3. A statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled as a result of a mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the notice, or their agent.

When we receive a complete counter notice, we send a copy of it, including your contact details, to the person who sent the notice, and tell them we will restore the material in 10 business days. We restore it between 10 and 14 business days after we receive your counter notice, unless the person who sent the notice tells us first that they have filed a court action to stop the infringement.

Knowingly misrepresenting that material was removed by mistake can also make you liable for damages under 17 U.S.C. § 512(f).

Repeat infringers

In appropriate circumstances, we close the accounts of people who repeatedly infringe copyright. As a rule, an account is closed once it has received valid notices on three separate occasions, and we may close an account sooner for clear or deliberate infringement. A notice that is withdrawn, or that is answered by a counter notice with no court action following, does not count.

Building from a picture, and other AI features

Pragte’s AI can build a design from a picture, such as a screenshot of a website or a photo of a printed invitation, and can make or change photos. These tools work from what they are given. They give no one any rights in someone else’s work, and Pragte does not check whether a site owner has those rights. A design made with the AI is treated like anything else on a site: if it uses your work without permission, send a notice as described above.

Trademarks and other problems

The DMCA covers copyright only. If a site uses your trademark in a way you believe is unlawful, use the same form and choose Trademark, or email legal@pragte.com. We review trademark notices under our Terms of Service and Acceptable Use Policy.

For anything else, such as a scam or harmful content, use Report abuse on the site or email abuse@pragte.com.
